Custody
The standard that courts will use in determining custody is the “best interests” of the child. There are a variety of factors that courts will take into consideration in making their determination. While courts will first look to granting joint custody to both parents, each case is handled on a case-by-case basis with the best interests of the child governing the outcome.

Visitation
During divorce proceedings or when parents otherwise separate, visitation and the amount of time that parents are allowed to spend with their children is a very highly debated issue. Visitation is the time that a child spends with his or her parents. California law recognizes the importance of allowing children to spend time with parents and favors frequent and continuing contact with both parents. Unless there is evidence that parenting time would be detrimental to the child’s best interests, visitation will generally be granted.
California courts encourage parents to come to an agreement concerning a visitation schedule. If the parents can agree on a schedule, the courts will generally uphold the agreement, unless the court determines that it contrary to best interests of the child. If the parties, however, cannot agree, the court will determine the matter and will issue an order specifying when the child will spend time with the non-custodial parent.
