Resolving Spousal Support Issues
Spousal support, sometimes referred to as alimony, is an issue that must be resolved in many divorce proceedings, particularly during high-asset divorce cases. One party may feel obligated to receive financial support from his or her ex. This is often the case where a person may not be able to immediately support themselves after the divorce, such as a person who spends the bulk of a marriage as a stay-at-home parent, or as the result of other factors.
The biggest challenge when it comes to spousal support issues is that there are no clear guidelines to determine who is eligible to receive support, how long payments should last and what the amount of payments should be. The most important considerations are need and ability to pay.
At Christy, Keith & Donnell Family Law Group, P.C., we help people across the Bay Area with support and all other divorce-related issues. Call us at 510-617-0479 to schedule a consultation with an experienced family law attorney.
Spousal Support Modifications And Termination
In general, spousal support is intended to be temporary. The amount of support payments will be established at the time the divorce is finalized. However, this does not necessarily mean that the decision is set in stone. If a person experiences a substantial change in circumstances, such as a job promotion with a significant pay increase, it may be possible to seek a modification to the order for support.
In other cases, it may be possible to seek a termination of support payments — for example, if the receiving party remarries or otherwise enters a cohabitating relationship.
Our lawyers can help with both modifications and termination. We understand that with family law issues, each marriage and each divorce is unique. Your case requires a considered, holistic approach to get the results desired.
